**VIP DAY SERVICE AGREEMENT**
This Customer Service Agreement (the "Agreement") is entered into between the customer (hereinafter referred to as the "Customer") and Danielle Grant / Your Mindset Mentor, represented by Danielle Grant, a service provider operating under Danielle G Consulting (hereinafter referred to as the "Provider"). This Agreement outlines the terms and conditions governing the provision of live group experiences, workshops, intensives, and related services by the Provider to the Customer.
1. SERVICES
The Provider agrees to deliver live group experiences, workshops, intensives, and related services (the “Services”) as described in the program outline provided by the Provider. The Customer acknowledges that the Provider is solely responsible for the development, delivery, and execution of the Services.
The Customer understands that participation in the Services requires active engagement and personal commitment to achieve desired outcomes. The Provider does not guarantee any specific results as outcomes depend on individual effort and circumstances.
2. PAYMENT
2.1 Fees and Payment Terms
All prices are in USD.
The Customer agrees to pay the fees specified by the Provider for the Services as set forth on the Provider's website or outlined in communication prior to purchase. Payment will be collected via credit card, PayPal, or other payment methods specified at the time of purchase.
2.2 Non-Refundable Policy
All payments made by the Customer are non-refundable. Due to the nature of the Services, which include live group experiences and intensives that require advanced planning and reservation, the Customer acknowledges that all sales are final.
If the Customer elects to pay in installments, payment will be automatically collected by the Provider on a monthly basis for the agreed-upon term. The Customer remains responsible for all payments, regardless of continued participation in the Services. By choosing the installment option, the Customer agrees they cannot terminate or cancel future payment obligations.
Failure to make timely payments may result in the immediate suspension or termination of access to the Services. The Customer warrants that all payment instruments, credit cards, and related billing information provided are accurate and that they are authorized to use such instruments.
3. PARTICIPATION AND ATTENDANCE
The Customer agrees to participate in the Services as scheduled by the Provider. Missed sessions, group calls, or live experiences will not be refunded or rescheduled. Access to supplemental materials, recordings (if provided), or additional resources is at the discretion of the Provider.
The Provider is not responsible for the Customer's failure to attend or participate due to personal scheduling conflicts, unforeseen circumstances, or other reasons.
4. INTELLECTUAL PROPERTY
All materials provided during or as part of the Services, including but not limited to program content, guides, exercises, recordings, and presentations, are the exclusive intellectual property of the Provider.
The Customer agrees not to reproduce, distribute, modify, or share these materials without the Provider's express written consent. Breach of this clause may result in immediate termination of access to the Services and potential legal action.
5. DISCLAIMERS AND LIMITATIONS OF LIABILITY
5.1 No Guarantee of Results
The Provider makes no guarantees regarding the outcomes or results of the Services. Participation in the Services does not guarantee any specific personal, professional, or financial results.
5.2 Limitation of Liability
The Provider shall not be held liable for any indirect, incidental, or consequential damages arising from the Customer’s participation in the Services.
5.3 Personal Responsibility
The Customer acknowledges that they are solely responsible for their own progress, decisions, and actions arising from their participation in the Services.
6. CONFIDENTIALITY
The Provider and Customer agree to maintain confidentiality regarding any sensitive or personal information shared during the Services. Group settings may involve the sharing of insights or personal reflections by other participants, and the Customer agrees to respect the confidentiality of others.
7. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of laws principles.
8. REFUND POLICY
Due to the nature of live group experiences and intensives, which require advance preparation, planning, and resource allocation, all payments are non-refundable and non-transferable.
By completing the purchase, the Customer agrees and acknowledges that:
They understand the terms of the Services being provided.
They have reviewed the program or experience outline and agree it meets their expectations.
In the rare event of Provider-initiated cancellation (e.g., due to unforeseen circumstances), the Provider will offer the Customer a rescheduled date or credit toward future Services.
9. FORCE MAJEURE
The Provider shall not be liable for any failure to perform or delay in performance of obligations under this Agreement due to events beyond reasonable control, including but not limited to natural disasters, government restrictions, pandemics, or technical disruptions.
10. ENTIRE AGREEMENT
This Agreement represents the entire understanding between the parties concerning the subject matter hereof and supersedes all prior agreements, representations, or warranties.
